The Journal and I agree that the Sixth Circuit is only a small improvement over the Fifth Circuit. However, if the Sixth Circuit does not reinstate the mandate, the appeal to the Supreme Court looks more difficult. The mandate still seems valid under OSHA’s power and federal supremacy, but its path has become more difficult.

Europe is the current global center of the pandemic. However, the 2.2 million death toll estimate by March strikes me as too high. Current European total COVID deaths are 1.4 million. I would expect most European deaths will come from countries where vaccinations are low (Eastern Europe). The bulk of the European population is in Western Europe.
